Zeldes Haeggquist & Eck (ZHE) Files Age Discrimination Lawsuit Against Largest U.S. Propane Distributor

AmeriGas Propane, the nation’s largest propane distributor, wrongfully terminated and discriminated against a 67-year-old employee based on his age, a lawsuit recently filed by Zeldes Haeggquist & Eck alleges.
Jay Reeb worked for AmeriGas as a propane delivery driver for more than 26 years without a single negative writeup before he was fired for forgetting to fill out a line item on a form, the suit alleges. Other younger employees who made the same mistake were not terminated or even reprimanded, according to lead counsel Alreen Haeggquist.
At the time of his firing, according to the suit, he was the oldest employee in the company’s San Diego office, which his colleagues, who called him “Gramps”, constantly reminded him.
“Jay Reeb was a model employee,” Haeggquist said. “He was always on time, he never called in sick, and he consistently received positive performance evaluations in his decades-long tenure with AmeriGas. In return for his 26 years of dedicated service – during which he never received a single written warning – he was summarily fired for a completely inconsequential, pretextual reason and in violation of the company’s internal policies.
“Quite simply, AmeriGas wanted him gone because he was older and more highly paid than most of its San Diego employees, and they wanted to replace him with someone younger and cheaper,” Haeggquist said.
The case is currently pending in the United States District Court for the Southern District of California. A trial date has not yet been set.
